As Seen On:

Lyft have misclassified their drivers as independent contractors instead of employees. Independent contractors do not have access to wages or benefits offered to full time employees. This misclassification can have implications for labor rights, benefits, and other legal protections. Workers classified as independent contractors may not be entitled to certain benefits, such as minimum wage, overtime pay, and employee benefits, which are typically afforded to full time workers.

INCENTIVE TO MISCLASSIFY

Companies like Lyft save significant amounts of money avoiding payment of the minimum wage, overtime, or even offer benefits, therefore providing financial incentive to misclassify employees as independent contractors.

“Misclassification is a serious issue that denies workers’ rights and protections under federal labor standards, promotes wage theft, allows certain employers to gain an unfair advantage over law-abiding businesses, and hurts the economy at-large,” the Labor Department said in a press release.

If you have driven for Lyft in the past three years, you may be entitled to compensation for back pay and reimbursement for other expenses.

Misclassified Drivers are deprived of:

Minimum wage for all hours worked between trip to pick a passenger up and begin assignment ridest, time spent driving awaiting a new assignment, and time spent completing rides.

Misclassified Drivers are deprived of:

Overtime wages for time and a half when working 40+ hours a week, as well as being forced to pay business expenses including: Cost of gas, phone and data costs, vehicle insurance, and maintenance.
